Regulation of Tourist Anchorage at Lakki of Leros Island

The company with the distinctive title “Moor & Dock PC” drafted the Special Regulations for the Operation of Tourist Anchorage at Lakki of Leros, located on the island of Leros, and these are as follows.

Article 1

Field of application.

The present Special Regulation applies to the land and sea zone of Tourist Anchorage of Lakki of Leros  of Leros, as defined in the topographic diagram attached, amended to no. T / 1747 / 23.4.1997 Ministerial decision of location and concession with no. 12448 / 06.07.2009, the sub no. 2574 / 11.02.2016 and the sub no. 5758 / 21.3.2019. 

The geographical coordinates of Tourist Anchorage of Lakki of Leros are, Latitude 37 ° 07.80 N and longitude 26 ° 50.90 E. 

The provisions of this Regulation and the decisions of the Administration are subject to all users of the premises, facilities, and in general the sea area and the land area of the Marina. 

All skippers, boat owners, crew members, and any other person or trader permitted by the Management the entrance to the Marina, using the Marina and its facilities, must follow the instructions and hints of the Management and comply with the instructions and directions of its staff. 

The Customs regulations, which apply to the port zone, also apply to the Marina zone.

The provisions of this Regulation apply as long as they do not conflict with the applicable Laws and Regulations.

Article 2

Services Provided.

In addition to the services defined in the General Rules of Operation, established by the joint decision No. T / 9803 / 5.9.2003 of the Ministers of Development and Merchant Shipping (Government Gazette B’ 1323), Tourist Anchorage of Lakki of Leros  is also providing the following services:

2.1 Electricity supply through 220 VAC power pillars with sockets of 16A and 32A and 380 VAC power pillars with sockets of 32A and 63A.

2.2 Water supply through taps Ø ½”.

2.3. Fire Extinguishing System, including Fire pillars, which include fire hydrants and individual hand fire extinguishers.

2.4 Fuel supply, which takes place in a designated area, designated by the berth shift Manager. Refueling is done through cooperating gas stations with specially designed fuel trucks to transport and supply the vessels.

2.5 Collection of solid waste and old batteries.

2.6.Collection of liquid waste, fuel residues, and the engine used oil using a Vacuum system with special H.D. Ø 38.

2.7. Biowaste collection is carried out with a cooperating bio-sewage collection company that uses a suitable truck that carries suitable vacuum pumps and equipment.

2.8. Boat lifting basin for lifting the vessels using a special self-propelled crane, including a land storage area for boats with a total area of 56,000 m2. This facility is in Partheni area, close to Leros airport, located at the north of the island of Leros.
The distance from Tourist Anchorage of Lakki of Leros is 9 N.M., and the coordinates are 37 ° 11.23 N and 26 ° 48.27 E. 
 
2.9 The additional accommodation and other services necessary for the boat owners, skippers, and crew members are covered by the local hotels, restaurants, food markets, and other shops, including bank branches, etc.

Article 3

Marina Management – Administration – Organization and Staffing for the provision of Services

3.1.The AdministratorAdministrator of Tourist Anchorage of Lakki of Leros  is the company with the distinctive title “Moor & Dock P.C.”

3.2 The Management of the mooring zone of the Tourist Port of Lakki is exercised by the respective Administrator of the company or by a Director who is appointed by a decision of the Administrator.

Management Responsibilities:

The Administrator, or the appointed Director, decides on all matters concerning the general operation of Tourist Anchorage of Lakki of Leros  always within the framework defined by the applicable Laws. The following responsibilities are indicative and shown below.

  1. a) Defines the composition of the staff in general and its duties.
  2. b) Recruits and fires seasonal staff.
  3. c) Assigns contracting special services, which the Company’s Personnel may not possibly serve.
  4. d) Decides on the coverage of existing needs in machinery and consumables and initiates the procedures for their supply.

e).Decides on the necessary repairs or improvements of the facilities in general and assigns their execution.

f).Decides on the insurance coverage of Tourist Anchorage of Lakki of Leros  and assigns to the appropriate insurance company with terms determined by the Directorate of Tourist Ports, Directorate of Spatial Planning & Infrastructure, Department of Contracts, and Control of the Ministry of Tourism.

  1. g) Competently determines and notifies the adjustment of the current fees for mooring and other services provided to the vessels.
  2. h) Is responsible for implementing the General Regulation for the Operation of Tourist Ports and this Special Regulation.
  3. i) Has the general responsibility for the proper operation of the Marina and the provision of all kinds of services and the services referred to the article 2 as above.

 j).Is in charge of the financial operation, provision of services, cleaning, technical support, maintenance and is responsible for any action or omission. 

3.3 The organization of the Marina departments is as follows:

3.3.4 CLEANING SERVICE DEPARTMENT
3.3.5 TECHNICAL SUPPORT AND MAINTENANCE DEPARTMENT

3.3.1 General Administration

The General Administration of the Marina is appointed by decision of the respective AdministratorAdministrator of the company with the responsibilities assigned and mentioned below.

Responsibilities of the General Administration of Tourist Anchorage of Lakki of Leros :

  1. a) Represents the Management of Tourist Anchorage of Lakki of Leros . 
  2. b) Has the general responsibility for implementing the General Regulation of Operation of Tourist Ports and this Special Regulation. 
  3. c) Has the general responsibility for the proper operation of the Marina and the provision of all kinds of services, including the services aforementioned in the previous article. 
  4. d) Supervises the financial exploitation, the provision of services, cleaning, technical support, maintenance and is responsible for any action or omission. 
  5. e) Notifies the Port Authority of Leros for any violation of the provisions of articles 4, 5, 7, and 8 of the General Regulation of Operation of Tourist Ports. 
  6. f) Has the responsibility of compiling the manual of Internal Operation of the Marina with instructions to the staff to exercise his duties. 
  7. g) Takes care of the insurance coverage of the anchorage as required by the services referred to in article 3 § 2 (f’) of the Ministry of Tourism.

3.3.2 Financial Exploitation Department

It consists of personnel appointed by the decision of the AdministratorAdministrator of the company or the appointed Director of the Marina. 

Responsibilities of the Economic Exploitation department

  1. a) Has the responsibility for the general financial Management of the Marina, e.g., the payment of the fees owed to the State, the collection of mooring fees, etc. 
  2. b) Has the responsibility for the observance of the recognized, in accordance with par. 5 of article 31 A’ of law 2160/1993 mooring pricelist and the other services provided to the vessels.
  3. c) Issues and observes the legal and tax data and books provided for the applicable provisions to collect the above-approved fees.

3.3.3 Service Provision Department

It consists of personnel who are hired by the company with the distinctive title “Moor & Dock PC” or appointed by the decision of the Director of the Marina.

Responsibilities of the Service Provision department

  1. a) Takes care of the provision of all kinds of services (e.g., Electricity, water supply) as mentioned in article 2 of this Regulation except those that fall within the competence of the Financial exploitation department, Cleaning, Technical Support, and Maintenance.

b).Ensuring the observance of the provisions of articles 5, 7, and 8 of the General Regulation of Operating Tourist Ports and immediately informs the Marina Management of any violation it finds.

c).Takes care of the facilitation of the People with Reduced Mobility in the areas of the Marina zone.

  1. d) Provides users with general facilities and information concerning, e.g., the environmental and cultural events and evaluations of the wider area and the movements from and to the Marina zone.
  2. e) Checks for the implementation of the current Firefighting Order. 

3.3.4 Cleaning Service Department.

Assigned by the Director of the Marina to a suitable employee of the Marina.

Responsibilities of the Cleaning Service

  1. a) Takes care of the daily cleanliness of the land areas and all kinds of facilities of the land and sea area of the Marina and takes care of the proper operation of the means and the cleaning materials.
  2. b) Ensures for the daily and until 20:00 hours collection of waste (recyclable or not), the collection of all kinds of useless objects, and their alternative placement in waste areas until they are removed by the waste trucks of the Municipality of Leros.
  3. c) Ensures the implementation of the provisions of article 4 of the General Rules of Operation of Tourist Ports and informing the Administration of the Marina for any violation it finds, submitting relevant proposals.
  4. d) Ensures the collection and disposal of hazardous – toxic waste (e.g., old batteries), oily residues, and biological residues by the existing provisions and law.
  5. e) In case of a pollution incident, the Management of the Marina is obligated to report to the Port Authority of Leros and immediately follow the Port Authority’s orders for its treatment.

3.3.5 Technical Support and Maintenance Department

It deals with all kinds of repair and maintenance work of port and land installations and equipment of the Marina. It includes the respective Technical Service of the company with the distinctive title “Moor & Dock P.C.”

The Management of the Marina assigns, to specialized personnel of the company with the distinctive title “Moor & Dock P.C.” or in specialized collaborators, concerning the maintenance or repair of the area and the equipment of the port and land facilities of the Marina, as well as the technical support and the provision of services to the vessels which are moored in the Marina. 

Article 4

Vessel size – Vessel categories

The total number of vessels that can moor in the Marina is thirty-two (30). This total number is broken down by boat categories as follows:

Article 5  

Permitted Speed – Vessel Docking Areas

5.1. The Skippers or vessel owners entering or moor in the Marina zone shall:

  1. a) Sail “calmly” if the weather conditions and the maneuvering possibilities of the vessel allow it, but never at a speed higher than five knots per hour.
  2. b) Should comply with the provisions of the International Conflict Prevention Regulation.
  3. c) Should fully comply with the signs and commands of Marina’s appointed staff and keep the priority rules when entering the Marina zone.
  4. d) To comply with the current formalities of movement of the vessels that are valid in all ports and Marinas.

5.2 The berths of vessels are defined as: (a) For vessels with L.O.A. 10 to 14  meters, the berths numbered 12 to 21, (b) For vessels with L.O.A. 14 to 20 meters the berths numbered 22 to 31, (c) For for vessels with L.O.A. 20 to 28 meters the berths numbered 5 to 11 and 32, (d) For vessels with L.O.A. 28 to 45 meters the berths numbered 1 to 4.

5.3 The Service Provider, after consultation with the General Management, may approve the mooring of a vessel of another category in the mooring position of vessels of another category if there are no requests/booking for mooring of this category.

Article 6

Right for Mooring Berths

6.1.The right of mooring exists only with the permission of the shift manager, referring to motor or sailing yachts, private or professional.

6.2.The shift manager of the Marina, if there are serious reasons (lack of required certificates, lack of insurance contract of the vessel, or lack of available seats, etc.), may refuse the offer of a berth to a vessel as referred to in par. 1 of this article.

Article 7

Anchorage system

7.1 Unauthorized mooring and stern mooring of any vessel is prohibited, as well as the occupation of any position, except the mooring zone indicated by the appointed staff of the Marina.

7.2 It is forbidden for any vessel to anchor up to a distance of 100 meters around the center of the Marina.

7.2 Skippers or shipowners entering the berthing area for the first time must inform the reception staff of the vessel’s specifications and fill in the document delivered to them; It is their responsibility to submit to the port authority all necessary documents for the arrival and departure of their vessels.

7.3 According to the declared data, the appointed staff, provide instructions to the vessel to berth to its corresponding position (permanent anchorage and stern mooring on the quay).

7.4. Vessels longer than 120 feet moored in a berth should use their anchoring system.

7.5 The Marina Management may order the relocation of the vessel in accordance with provisions of article 8 of the General Regulation of Operation of Tourist Ports.

7.6 The vessel’s Skipper has the responsibility and must take care of its vessel safety and take any appropriate measures dictated by the naval experience.

7.7 The instructions of the appointed staff of the Marina do not dismiss responsibility of the Skipper of the vessel, both for the handling of the vessel within the port and its mooring on the permanent anchorage or the handling of the sterns.

Articles 8

Safety measures and protection of vessels and users of the berth.

8.1 User responsibility

  1. a) Anyone who uses part of the berthing area or any facilities, i.e., port or land facilities, fuel supply area, and the permanent anchorage, of his own free will or upon instruction of the Marina Management and appointed staff, is solely responsible for any infringement or damage is done through his fault either to a third party or to themselves.
  2. b) In any case of change of ownership of any vessel moored at a berth of the Marina, the vessel owner should inform in writing the Marina Management for any changes they are willing to make regarding any change to the ownership of the vessel, stating the name, the surname of the buyer and the date of transfer.
  3. c) All moored vessels must always be in good condition and regularly maintained to be in good condition, following the applicable provisions and rules.
  4. d) If a special guard is placed on a non-crewed vessel by the Skipper or the boat owner, they must notify the Marina Management in writing.
  5. e) The owners of the vessels (foreigners or nationals) must notify in writing the Marina Management for the person who will represent them during their absence and submit the written acceptance from this person for his duty.

8.2 Fire – Explosion

  1. a) The Marina Management must take the necessary security and fire protection measures provided in article 3 of the General Rules of Operation of the Tourist Port.
  2. b) Any event of fire or explosion will be immediately declared to the Port Authority, the Fire Department, and the Marina Administration should take all appropriate measures immediately. At the same time, it will immediately seek the extinguishing or the reduction of the fire with the fire extinguishing system of the Marina and all the means available to the vessels and their crews.

Article 9

Other issues

9.1 Order and cleanliness

  1. a) Swimming and sports, and fishing are not allowed inside the sea area of the Marina.
  2. b) It is forbidden to abandon in the sea or land areas of the Marina dinghies or canoes or any other kind of vessel. The Marina Management bears no responsibility for damages or loss.
  3. c) It is forbidden to abandon tools, auxiliary boats, rigging wires and terminals, hoses, cables, sails, and generally all kinds of equipment in the anchorage areas. Marina Management does not bear any responsibility for any loss or damage to the above items. The owner of these items will be charged for any storage or removal costs.
  4. d) It is forbidden to dump in the sea or land areas of the Marina fuel, unsuitable for eating food and generally objects and waste that may contaminate the area. Violation of this provision entails the imposition of sanctions under current legislation.
  5. e) The use of quays and piers for deposition, placement of auxiliary vessels, or any other object is prohibited, with the exemption of those that the Marina Management permitted.
  6. f) Pollution of the quays and piers in any way is prohibited. The vessel’s crews must maintain their cleanliness in the area they occupy.
  7. g) Every day at the set time, the vessels’ waste should be placed in waterproof bags in a specific place that is very close to the Marina area where there is a relevant sign, to be received by the cleaning service of the Municipality of Leros.
  8. h) It is not allowed to cause any noise that may disturb the occupants of the moored boats.
  9. i) Pets must be under the control of their owners.
  10. j) It is not allowed any maintenance or refit work of a vessel, or diving, without the required permits as defined by the provisions governing the Marina.
  11. k) The use of power by the generators of the boats that may be deemed necessary to meet the needs of the vessels is allowed only between 09.00 am. and 2.00 pm.
  12. l) Vessel maintenance work and minor repairs that cause relative noise are allowed only between 08.30 am and 2:30 pm each.
  13. m) The relevant provisions for common peace also apply in the area of Marina.
  14. n) It is not allowed in any way, direct or indirect advertising of services or products, on land and sea of the Marina without the written consent of the Marina Management.
  15. o) It is not allowed the entry or the parking of any vehicles in the Marina zone without the permission of the Marina Management.

9.2 Case of non-payment of royalties

The following vessels are exempted from the payment of mooring fees:

  1. a) Vessels that resort to the anchorage zone due to force majeure (bad weather conditions, mechanical damage, etc.) make the vessel’s voyage dangerous.

Any vessel that may resort to the anchorage due to bad weather is obliged to leave the Marina after announcing the end of the said prohibition of sailing. If the vessel stays at the Marina after the expiration of the prohibition, then it is obliged to pay the Marina fees calculated from the end of the said prohibition. Prohibitions and permits are based on the announcements of the Central Port Authority of Piraeus.

  1. b) Vessels owned and used by the Heads of State for any reason, including mechanical damage.

Article 10

Notification of Operating Regulations

With the care of the Marina Management, it is delivered to the Skipper or boat owner or representative or user of each vessel, moored in the Marina zone, a copy of the General Regulation of Operating Tourist Ports and this Special Regulation.
